Chapter 1 General Provisions

Article 1 (Purpose and Legislative Basis)

In order to strengthen the administration of house demolishing entities, the present Measures are enacted in accordance with the Provisions on the Administration of Urban House Demolishing Entities promulgated by the Ministry of Construction and the Measures of Beijing Municipality for the Administration of Urban House Demolishment, and in light of the actual situations of this Municipality.

  第一条 〔立法目的和依据〕
  为加强本市房屋拆迁单位管理,根据建设部《城市房屋拆迁单位管理规定》和《北京市城市房屋拆迁管理办法》等相关规定,结合本市实际情况,制定本办法。

Article 2 (Scope of Application)

Any entity engaged in demolishment of houses and the accessories thereof in this Municipality (hereinafter referred to as house demolishing entities) must abide by the present Measures.

  第二条 〔适用范围〕
  凡在本市从事房屋及其附属物拆迁的单位(以下简称房屋拆迁单位),均须遵守本办法。

Article 3 (Types of Demolishing Entities)

The house demolishing entities as mentioned in the present Measures shall include self-demolishing entities and entrusted demolishing entities.

Self-demolishing entities shall refer to the real estate enterprises qualified for house demolishing that have permanent internal demolishing departments, and that may demolish the houses and accessories thereof within the land it uses pursuant to the provisions of the License for House Demolishing according to law.

Entrusted demolishing entities shall refer to the entities qualified for house demolishing that, upon entrustment of the demolisher and within the scope of entrustment, demolish the houses and the accessories thereof within the land the demolisher uses pursuant to the provisions of the License for House Demolishing according to law.

  第三条 〔拆迁单位类型〕
  本办法所称房屋拆迁单位,包括自行拆迁单位和受托拆迁单位。
  自行拆迁单位是指内部常设拆迁部门,具备房屋拆迁资格,按照《房屋拆迁许可证》的规定依法对本单位用地范围内的房屋及其附属物实施拆迁的房地产开发企业。
  受托拆迁单位是指具备房屋拆迁资格,受拆迁人委托,在代理权限范围内,按照《房屋拆迁许可证》的规定依法对拆迁人用地范围内的房屋及其附属物实施拆迁的单位。

Article 4 (Qualification Administration System)

This Municipality applies the system of qualification administration to the house demolishing entities; any entity without the qualification certificate for house demolishing may not engage in the business of house demolishing.

This Municipality applies the system of practice qualification administration to the house demolishing personnel; any person without the post certificate for house demolishing may not engage in the work of house demolishing.

  第四条 (资质管理制度)
  本市对房屋拆迁单位实行资质管理制度;未取得房屋拆迁资质证书的单位,不得从事房屋拆迁业务。
  本市对房屋拆迁工作人员实行执业资格管理制度;未取得房屋拆迁岗位证书的人员,不得从事房屋拆迁工作。

Article 5 (Principles for Demolishment)

House demolishing entities shall stick to the following principles in house demolishment:

1) Demolishing according to law;

2) Demolishing in a civilized manner and providing normative services; and

3) Fair competition.

  第五条 〔拆迁原则〕
  房屋拆迁单位实施房屋拆迁,应当坚持以下原则:
  (一)依法实施拆迁;
  (二)文明拆迁,规范服务;
  (三)平等竞争。

Article 6 (Department in charge)

The Beijing Municipal Administration of State Land, Resources and Housing (hereinafter referred to as ASLRH) shall be the department in charge of the house demolishing entities of this Municipality, and shall be responsible for the administration of the house demolishing entities of the whole municipality.

The administrations of land resources and housing of the districts and counties (hereinafter referred to as district and county administrations) shall be in charge of the administration of the house demolishing entities within their respective districts or counties.

  第六条 〔主管部门〕
  北京市国土资源和房屋管理局(以下简称市国土房管局)是本市房屋拆迁单位的主管机关,负责全市房屋拆迁单位的管理工作。
  各区、县国土资源和房屋管理局(以下简称区、县国土房管局)负责本区、县范围内房屋拆迁单位的管理工作。

Article 7 (Requirements for Demolishing Qualification)

A house demolishing entity shall, after obtaining the business license, file the qualification application with ASLRH, and only after obtaining the Qualification Certificate for House Demolishing of Beijing Municipality (hereinafter referred to as Qualification Certificate) upon examination and ratification, may that entity engage in the demolishing business.

  第七条 〔拆迁资质要求〕
  房屋拆迁单位在取得营业执照后,应当向市国土房管局提出资质申请,经审查核准并取得《北京市房屋拆迁资质证书》(以下简称《资质证书》)后,方可从事拆迁业务。

Article 8 (Conditions for the Qualification of Entrusted Demolishing Entity)

An entrusted demolishing entity shall meet the following conditions:

1) Being able to assume civil liabilities independently;

2) Having definite name, organizational structure and fixed office place;

3) Having sound articles of association or management system;

4) Having the professional demolishing personnel and managerial personnel accommodated to the demolishing business; and

5) Having the registered capital accommodated to the demolishing business.

  第八条 〔受托拆迁单位资质条件〕
  受托拆迁单位应当具备下列条件:
  (一)能够独立承担民事责任;
  (二)有明确的名称、组织机构和固定的办公场所;
  (三)有健全的组织章程或管理制度;
  (四)有与拆迁业务相适应的拆迁专业人员和管理人员。
  (五)有与拆迁业务相适应的注册资本。

Article 9 (Documents to be Submitted for the Qualification of Entrusted Demolishing Entity)

An entrusted demolishing entity shall submit the following documents to apply for qualification examination:

1) Application form for examination of demolishing qualification;

2) Examination and approval form for qualification of house demolishing entity of Beijing Municipality;

3) Corporation business license (submitting the original and keeping the duplication);

4) Articles of association or management system;

5) Identity certificates and the resumes of demolishing work experience of the major principals; and valid certificates of the demolishing professionals and managerial personnel;

6) Certificate of the office place; and

7) Other relevant documents to be submitted as required by ASLRH.

  第九条 〔办理受托拆迁单位资质应提交文件〕
  受托拆迁单位申请资质审查,应当提交下列文件:
  (一)拆迁资质审查申请书;
  (二)北京市房屋拆迁单位资质审批表;
  (三)法人营业执照(交验原件并留复印件);
  (四)组织章程或管理制度;
  (五)主要负责人的身份证明及从事拆迁业务的工作简历;拆迁专业人员和管理人员的有效证明文件;
  (六)办公场所证明文件;
  (七)市国土房管局要求提交的其他有关文件。

) F& R' u+ e) ]5 z+ P* ~

Article 10 (Administration of the Qualification Grades of Entrusted Demolishing Entities)

Qualification of entrusted demolishing entity is classified into 3 grades, namely the first grade, the second grade and the third grade.

1) A newly established entrusted demolishing entity shall be granted the third grade qualification if it meets the prescribed conditions upon examination.

A third-grade entrusted demolishing entity shall meet the following conditions:

1. Having more than 10 demolishing professionals, among whom there shall be more than 1 demolishment project manager;

2. Having more than 1 managerial personnel each with the primary or above technical title in engineering technology, law, economy or finance;

3. Having more than 2 million Yuan registered capital.

2) A third-grade entrusted demolishing entity shall meet the following conditions to be promoted to a second-grade entrusted demolishing entity:

1. Having more than 20 demolishing professionals, among whom there are more than 2 demolishment project managers;

2. Having more than 1 managerial personnel each with the middle-level or above technical title in engineering technology, law, economy or finance;

3. Having more than 4 million Yuan registered capital;

4. Having finished 15 demolishment projects, each of which involved more than 50 households, after obtaining the third-grade qualification;

5. Being determined as excellent in the annual qualification examination of the last year.

3) A second-grade entrusted demolishing entity shall meet the following conditions to be promoted to a first-grade entrusted demolishing entity:

1. Having more than 40 demolishing professionals, among whom there are more than 3 demolishment project managers;

2. Having more than 1 managerial personnel each with the high-level or above technical title in engineering technology, law, economy or public finance;

3. Having a registered capital of more than 6 million Yuan;

4. Having finished 30 demolishment projects, each of which involved more than 100 households;

5. Having finished various kinds of demolishment projects including general demolishment and reform of dangerous houses;

6. Being appraised as excellent in the annual qualification examination of the last year.

  第十条 〔受托拆迁单位资质等级管理〕
  受托拆迁单位的资质分为一级、二级、三级共三个等级。
  (一)新设立的受托拆迁单位,经审查符合规定条件的,授予三级资质。
  三级受托拆迁单位应当具备下列条件:
  1、有10名以上拆迁专业人员,其中拆迁项目经理1名以上;
  2、有工程技术、法律、经济或财务初级以上职称的管理人员各1名以上;
  3、有200万元以上的注册资本。
  (二)三级受托拆迁单位晋升二级受托拆迁单位,应当具备下列条件:
  1、有20名以上的拆迁专业人员,其中拆迁项目经理2名以上;
  2、有工程技术、法律、经济或财务中级职称的管理人员各1名以上;
  3、有400万元以上的注册资本;
  4、获得三级资质后完成过50户以上的拆迁项目15个;
  5、上一年度资质年审结果为优秀。
  (三)二级受托拆迁单位晋升一级受托拆迁单位,应当具备下列条件:
  1、有40名以上的拆迁专业人员,其中拆迁项目经理3名以上;
  2、有具备工程技术高级职称、经济或财务管理高级职称、法律执业资格证书的管理人员各1名以上;
  3、有600万元以上的注册资本;
  4、完成过100户以上的拆迁项目30个;
  5、完成过包括一般货币拆迁、房改危改在内的各种类型拆迁项目;
  6、上一年度资质年审结果为优秀。

Article 11 (Practice Restrictions on Entrusted Demolishing Entities)

1) Practice restrictions on third-grade entrusted demolishing entities:

1. An entity may not accept the demolishment business involving more than 200 households;

2. An entity may not accept more than 2 demolishment projects at the same time;

3. The total number of households involved in the demolishment projects accepted by an entity at the same time may not be more than 400.

2) Practice restrictions on second-grade entrusted demolishing entities:

1. An entity may not accept the demolishment business involving more than 300 households;

2. An entity may not accept more than 3 demolishment projects at the same time;

3. The total number of households involved in the demolishment projects accepted by an entity at the same time may not be more than 1000.

3) Practice restrictions on first-grade entrusted demolishing entities:

1. An entity may not accept more than 4 demolishment projects at the same time;

2. The total number of households involved in the demolishment projects accepted by an entity at the same time may not be more than 3000.

The projects accepted by an entrusted demolishing entity at the same time as mentioned in this Article shall be calculated on the basis of the demolishment projects accepted by the entrusted demolishing entity that have been issued the license for house demolishing and that are not completed yet; however, if there are few houses left even if a project accepted by the entrusted demolishing entity hasn’t been completed, that project may be excluded upon verification by the district or county administration.

  第十一条 〔受托拆迁单位从业限制〕
  (一)三级受托拆迁单位从业限制:
  1、不得承接200户以上的拆迁业务;
  2、同时承接拆迁项目不超过2个;
  3、同时承接总户数不超过400户。
  (二)二级受托拆迁单位从业限制:
  1、不得承接300户以上的房屋拆迁业务;
  2、同时承接拆迁项目不超过3个;
  3、同时承接总户数不超过1000户。
  (三)一级受托拆迁单位从业限制:
  1、同时承接项目不超过4个;
  2、同时承接总户数不超过3000户。
  本条所称受托拆迁单位同时承接项目,按照受托拆迁单位所承接的已核发房屋拆迁许可证且尚未结案的在施拆迁项目计算;但是经区、县国土房管局核定,受托拆迁单位所承接项目虽未结案,但剩余户数很少的,可以不予计入。

Article 12 (Conditions for the Qualification of Self-Demolishing Entity)

A self-demolishing entity shall meet the following conditions:

1) Having the qualification for real estate development;

2) Having the permanent demolishing department;

3) Having sound management system;

4) Having more than 8 demolishing professionals, among whom there shall be more than 1 demolishment project manager.

  第十二条 〔自行拆迁单位资质条件〕
  自行拆迁单位须具备下列条件:
  (一)有房地产开发资质;
  (二)有常设的拆迁部门;
  (三)有健全的管理制度;
  (四)有8名以上拆迁专业人员,其中拆迁项目经理1名以上。

Article 13 (Documents to be submitted for the Qualification of Self-Demolishing Entity)

A self-demolishing entity must submit the following documents to apply for the qualification examination:

1) Application form for examination of demolishing qualification;

2) Examination and approval form for qualification of house demolishing entity of Beijing Municipality;

3) Approval documents for establishment of the entity issued by the department in charge at higher level;

4) Management system of the demolishing department;

5) Resume of the demolishing principal and the valid certificates of the demolishing professionals regarding the work experience of demolishing

6) Certificate of the office place; and

7) Other relevant documents.

  第十三条 〔办理自行拆迁单位资质应提交文件〕
  自行拆迁单位申请资质审查,须提交下列文件:
  (一)拆迁资质审查申请书;
  (二)北京市房屋拆迁单位资格审查审批表;
  (三)上级主管部门组建机构的批准文件;
  (四)拆迁部门管理制度;
  (五)拆迁负责人从事拆迁业务的工作简历和拆迁专业人员有效证件;
  (六)办公场所证明文件;
  (七)其他有关文件。

Article 14 (Issuance of the Qualification Certificate)

For an entity meeting the prescribed conditions upon examination and ratification, ASLRH shall issue the Qualification Certificate for House Demolishing of Beijing Municipality within 20 workdays from the day of receiving all of the materials.

The Qualification Certificate of an entrusted demolishing entity shall indicate the qualification grade of that entity.

A house demolishing entity shall hang the Qualification Certificate at its office place or on the demolishment scene.

  第十四条 〔核发资质证书〕
  经审查核准,对符合规定条件的单位,市国土房管局应当在收齐全部材料之日起20个工作日内核发《北京市房屋拆迁资质证书》。
  受托拆迁单位的《资质证书》上应当载明其资质等级。
  房屋拆迁单位应将《资格证书》在其办公场所或拆迁现场办公地点悬挂出示。

Article 15 (Qualification Administration of the Branch of Entrusted Demolishing Entity)

Where an entrusted demolishing entity sets up any branch, it shall apply to ALHR for examination of the demolishing qualification of the branch by taking with it the business license of the branch. The branch may undertake demolishing business upon examination and ratification; however, its civil liabilities shall be borne by the entrusted demolishing entity. The business undertaken by the branch shall be managed as that undertaken by the entrusted demolishing entity, and the total amount of business undertaken by the entrusted demolishing entity and its branches may not exceed the standard prescribed in Article 11 of the present Measures.

  第十五条 〔受托拆迁单位分公司资质管理〕
  受托拆迁单位设立分公司的,应当持分公司营业执照到市国土房管局申请办理分公司的拆迁资质审查。经审查核准的,分公司可以承接拆迁业务,但是其民事责任由该受托拆迁单位承担;分公司所承接业务按照该受托拆迁单位承接的业务管理,受托拆迁单位及其分公司承接业务总量不得超过本办法第十一条规定的标准。

Article 16 (Splitting and Merger)

Where a house demolishing entity is split or merged, it shall go through the formalities for nullification of the Qualification Certificate with ALHR within 30 days from the day of ratification and registration of the splitting or merger by the administrative department of industry and commerce, and shall over again apply for the qualification examination of demolishing entity.

  第十六条 〔分立、合并〕
  房屋拆迁单位发生分立、合并的,应当在工商行政管理机关核准登记之日起30日内向市国土房管局办理《资质证书》注销手续,并重新申请拆迁单位资质审查。

Article 17 (Alteration)

Where a house demolishing entity alters its name, legal representative, demolishing principal, office place or contact telephone, it shall put on record with ASLRH within 30 days from the day of ratification and registration of the alteration by the administrative department of industry and commerce.

  第十七条 〔变更〕
  房屋拆迁单位变更名称、法定代表人、拆迁负责人、办公场所和联系电话的,应当在工商行政管理机关核准变更登记之日起30日内向市国土房管局备案。

Article 18 (Termination)

Where a house demolishing entity is terminated as a result of being nullified, being cancelled, revocation of business license, or other reasons, it shall turn back the Qualification Certificate to ASLRH within 30 days from the day of nullification of the registration or revocation of the business license by the administrative department of industry and commerce.

  第十八条 〔终止〕
  房屋拆迁单位因注销、被撤销、被吊销营业执照或其他原因终止营业的,应当在工商行政管理机关注销登记或吊销营业执照之日起30日内,向市国土房管局交回《资质证书》。

The demolishing personnel shall receive the training on demolishing business, relevant laws and regulations, and professional ethics arranged for by the district and county administrations.

For the demolishing personnel that have received the training and passed the assessment given by ASLRH, ASLRH shall issue to them the graduation certificate.

ASLRH shall issue the post certificate to demolishing personnel at the application by the house demolishing entity and on the basis of the graduation certificate of the demolishing personnel.

The post certificate of demolishing personnel shall be uniformly drawn from ASLRH by the demolishing entity to which those personnel belong.

Article 22 (Practice Requirements)

Article 23 (Project Examination)

In house demolishment, a house demolishing entity shall submit the post certificates of the demolishing personnel in charge of the relevant projects to the district or county administration of the place of demolishment for project examination, and shall make remarks on the post certificates.

In performance of duties, the demolishing personnel shall present to the relevant personnel their post certificates that have passed the project examination by the district or county administration; the personnel without post certificates may not engage in any demolishing work.

  拆迁工作人员履行职务时,应当向拆迁当事人或有关人员出示经区、县国土房管局项目审验的岗位证书;无岗位证书人员不得从事拆迁工作。

Article 24 (Award and Punishment)

ASLRH shall award the demolishing personnel that have made outstanding achievements in house demolishment; and ASLRH shall nullify the Post Certificate of the demolishing personnel that have committed law-breaking or rule-breaking acts and caused bad influence in house demolishment.

Any personnel whose Post Certificate has been nullified shall not be issued the Post Certificate again within 3 years.

A house demolishing entity shall carry out demolishment strictly in accordance with the Measures of Beijing Municipality for the Administration of Urban House Demolishment and the relevant provisions, and thus to guarantee the demolishment quality.

Article 27 (Contract of Entrusted Demolishment)

Where an entrusted demolishing entity accepts an entrustment for house demolishment, it shall sign a written entrustment contract with the demolisher. Where the project is subject to bidding pursuant to the provisions of the state and this Municipality, the demolishing entity shall be determined through bidding.

The entrustment contract shall be put on record with the district or county administration of the place where the houses to be demolished are located.

Article 28 (Prohibition on Subcontracting)

An entrusted demolishing entity may not, after accepting an entrustment of house demolishment, transfer the rights and obligations under the contract by any means.

Where the demolishment scale of a project is relatively large and it is difficult to have only one demolishing entity to undertake the project, the demolisher may entrust several demolishing companies to carry out the demolishment at the same time.

Article 29 (Fair Competition)

In acceptance of demolishment entrustments, an entrusted demolishing entity shall abide by the principles of good faith and fair competition, observe the generally accepted business ethics, and may not take any wrongful competitive means to damage the legitimate rights and interests of other entities and individuals.

Article 30 (Administration of Demolishment Scene)

A demolishing entity shall set up a temporary office on the demolishment scene.

A demolishing entity shall publicize the following contents at the office on the demolishment scene:

1) License for demolishing;

2) Demolishment range;

3) Qualification certificate of the demolishing entity;

4) Names of the demolishing personnel;

5) Relevant policies on demolishment;

6) Work disciplines for demolishment.

A supervisory telephone shall be set up on the demolishment scene for the convenience of the people, and thus to accept the public supervision by those whose houses are demolished.

  拆迁单位应当在拆迁现场设临时办公场所。
  拆迁单位应当在拆迁现场办公场所将下列内容进行公示:
  (一)拆迁许可证;
  (二)拆迁范围;
  (三)拆迁单位资质证书;
  (四)拆迁工作人员姓名;
  (五)拆迁相关政策;
  (六)拆迁工作纪律。
  拆迁现场应设便民监督电话,接受被拆迁人的公开监督。

Article 34 (Materials for Annual Examination)

ASLRH shall carry out annual examination of the house demolishing entities of this Municipality.

The house demolishing entities shall submit to ASLRH the following materials prior to the last workday of January of each year:

1. Annual examination form of house demolishing entity of Beijing Municipality;

2. Qualification Certificate of House Demolishing Entity;

3. Post certificates of the demolishing personnel;

4. Work summing-up and demolishment statistics form of the last year; and

5. Other materials to be submitted as required by ASLRH.

The result of annual examination shall be indicated on the Qualification Certificate of a house demolishing entity and be publicized.

Article 36 (Excellent Demolishing Entity)

A house demolishing entity that carried out the demolishment according to law, received good social comments and made outstanding achievements in the demolishment work in the previous year, and that meets the following conditions, shall be determined as excellent in the annual examination.

1) Requirements on business volume:

1. In case of a third-grade company, more than 3 projects and 600 households;

2. In case of a second-grade company, more than 5 projects and 1,000 households;

3. In case of a third-grade company, more than 7 projects and 1,500 households.

2) No collective complaint for the demolishment projects accepted in the last two years; the number of individual complaints filed by the residents are fewer than 3% of the number of households involved in the demolishment projects accepted.

3) With respect to the projects accepted in the previous year, more than 80% of the residents signed the agreement within the movement period promulgated by the district or county administration; the number of applications for ruling filed to the district or county administration is fewer that 3% of the total number of the households.

4) Filling in the statistics statements pursuant to the requirements; and handling, in a careful and timely manner, the letter complaints filed by the residents and other problems relating to the demolishment that are transferred by the departments in charge of demolishment of the municipality, districts and counties.

5) Patiently publicizing and explaining and strictly carrying out the policies on demolishment; and providing high-quality services to the demolishment parties;

6) Establishing relatively normative, complete and systematic internal management system, and using modern management modes and means.

The proportion of excellent demolishing entities determined each year shall not exceed 5% of the total number of demolishing entities of the whole municipality. ASLRH shall award the excellent house demolishing entities.

  第三十六条 〔优秀拆迁单位〕
  对于在上一年度拆迁工作中能够依法实施拆迁,社会反映良好,工作业绩突出,且符合下列条件的房屋拆迁单位,年审评定为优秀。
  (一)业务量要求:
  1、三级公司3个以上项目、600户以上;
  2、二级公司5个以上项目、1000户以上;
  3、一级公司7个以上项目、1500户以上。
  (二)近二年所承接拆迁项目无集体访;居民个访量低于所承接拆迁项目总户数的3%。
  (三)上一年度所承接项目在区县国土房管局公告的搬迁期限内居民签协议比例80%以上;向区县国土 房管局申请裁决的比例低于居民总户数的3%。
  (四)按要求填报统计报表;认真及时办理市、区县拆迁主管部门批转的群众信访件及其他拆迁相关问题。
  (五)耐心宣传解释、严格贯彻执行拆迁政策;为拆迁当事人提供优质服务;
  (六)建立比较规范、完整、系统的内部管理制度,使用现代化管理模式和手段。
  每年评定为优秀拆迁单位的比例不超过全市拆迁单位总数的5%。市国土房管局对优秀房屋拆迁单位予以表彰。

Article 37 (Qualified Demolishing Entity)

A house demolishing entities that carried out demolishment according to law, received no bad social comments and made good achievements in the demolishment work in the previous year and that meets the following conditions shall be determined as qualified in the annual examination:

1) Accepting more than 1 demolishment projects in the last two years;

2) Receiving no collective complaint filed for rule-breaking acts with respect to the demolishment projects accepted in the last two years.

3) Filling in the statistics statements and handling the letter complaints filed by the residents and other problems relating to demolishment that are transferred by the departments in charge of demolishment of the municipality, districts and counties pursuant to the requirements.

4) Committing no serious rule-breaking demolishing act; and

5) The internal management of the company is relatively normative.

  (二)近二年所承接拆迁项目无因拆迁违规操作而致集体访。
  (三)按要求填报统计报表和办理市、区县拆迁主管部门批转的群众信访件及其他拆迁相关问题。
  (四)无严重违规拆迁行为;
  (五)公司内部管理比较规范。

Article 38 (Unqualified Demolishing Entity)

A house demolishing entity that has committed any of the following acts in violation of the laws and regulations on demolishment, and that had serious circumstances and caused bad influence in the demolishment work in the previous year shall be determined as unqualified in the annual examination:

1) Failing to negotiate and sign an agreement with those whose houses are demolished, demolishing the houses without the ruling by the district or county administration or the government, or committing other barbarous demolishing acts and causing bad influence;

2) Operating in violation of the rules and with rough attitude, and thus incurring collective complaints or other severe acts by the residents whose houses are demolished, and causing bad influence; or

3) Committing other rule-breaking demolishing acts and causing bad influence in the demolishment.

  在上一年度拆迁工作中有下列违反拆迁法律法规的行为,情节严重、影响恶劣的房屋拆迁单位,年审评定为不合格:
  (一)在拆迁中未与被拆迁人协商签订协议、未经区县国土房管局或政府裁决即对被拆迁人房屋实施拆除及实施其他野蛮拆迁行为,影响恶劣的;
  (二)在拆迁中违规操作、态度粗暴,引起被拆迁居民集体访或其他激烈行为,影响恶劣的;
  (三)拆迁中有其他违规拆迁行为,影响恶劣的。

Article 39 (Treatment to the Entities Unqualified in Annual Examination)

With respect to a house demolishing entity determined as unqualified in the annual examination, ASLRH may suspend its qualification for house demolishing and order it to rectify within a prescribed time limit. Where the house demolishing entity fails to rectify within the prescribed time limit or is still unqualified after the rectification, ASLRH may lower its qualification grade or disqualify it for house demolishing according to the situations. A house demolishing entity that has been disqualified for house demolishing shall not be issued the Qualification Certificate within 3 years.

  对年度审核不合格的房屋拆迁单位,市国土房管局可暂停其房屋拆迁资格并责令限期整顿。房屋拆迁单位在限定期限内未进行整顿,或整顿后仍不合格的,市国土房管局根据情况可以降低其资质等级或者取消其房屋拆迁资格。被取消房屋拆迁资格的房屋拆迁单位三年内不再核发《资质证书》。

Article 40 (Treatment to Entities Failing to Participate the Annual Examination)

Where a house demolishing entity fails to submit the materials for annual examination, ASLRH may order that entity to submit those materials within a prescribed time limit, and suspend its qualification for house demolishing. If the entity fails to submit the materials within the prescribed time limit, ASLRH may disqualify it for house demolishing.

  第四十条 〔不参加年审单位的处理〕
  房屋拆迁单位未申报年度审核材料的,市国土房管局可以责令其限期申报年度审核材料,并暂停其房屋拆迁资格。在限定期限内仍未申报年审材料的,市国土房管局可以取消其房屋拆迁资质。

Article 41 (Promotion)

A second-grade or third-grade entrusted demolishing entity that has met the conditions for the next higher grade qualification and that has been determined as excellent in the annual examination may apply to ASLRH for promotion of its qualification grade.

Where an entrusted demolishing entity applies for promotion of qualification grade, the demolishment achievements of that entity shall be calculated starting from the day on which that entity obtained its present qualification grade.

  第四十一条 〔晋级〕
  已经符合较高一级资质等级条件,而且年审评定为优秀的二级或三级受托拆迁单位,可以向市国土房管局申请晋升资质等级。
  受托拆迁单位申请晋升资质等级的,其拆迁工作业绩自该单位取得现有资质等级之日起计算。

Article 42 (Demotion)

ASLRH may demote the qualification grade of an entrusted demolishing entity that no longer meets the conditions for its present qualification grade.

ASLRH may demote the qualification grade of a demolishing entity that has been determined as unqualified in the annual examination and that is still unqualified after rectification within the prescribed time limit.

  第四十二条 〔降级〕
  对不符合原定资质等级条件的受托拆迁单位,市国土房管局可以降低其资质等级。
  对年审结果为不合格,经限期整顿后仍不合格的,市国土房管局可以降低其资质等级。

Article 43 (Entity Accepting no Business in Two Years)

An entrusted demolishing entity that hasn’t accepted any demolishing business in the last two years shall apply for the examination of demolishing qualification over again.

  受托拆迁单位近二年未承接拆迁业务的,应当重新申请拆迁资质审查。

Article 44 (Certificate Administration)

No entity or individual may forge, alter or transfer the Qualification Certificate and Post Certificate. An entity losing the Qualification Certificate must declare invalidation of that certificate on a newspaper before it can apply for a substitute with ASLRH. A demolishing person losing the Post Certificate must take his/her a written repentance and the entity certificate to ASLRH to apply for a substitute.

  第四十四条 〔证书管理〕
  任何单位和个人不得伪造、涂改或转让《资格证书》和《岗位证书》。《资格证书》遗失的,必须登报声明作废后,方可向市国土房管局申请补发。拆迁工作人员遗失《岗位证书》,必须持本人书面检查和单位证明向市国土房管局申请补发。

Article 45 (Effectiveness)

The present Measures shall come into effect on May 1, 2003. The Measures of Beijing Municipality for the Administration Urban House Demolishing Entities promulgated by ASLRH on November 10, 1999, shall be repealed at the same time.

  第四十五条 〔生效〕
  本办法自2003年5月1日起施行。市国土房管局1999年11月10日发布的《北京市城市房屋拆迁单位管理办法》同时废止。
